TENANCY AGREEMENT OF LIMITED DURATION FOR THE LEASE OF PARTLY OR FULLY FURNISHED LIVING ACCOMMODATION

GENERAL
2.1 Leasing/Renting
The accommodation is Iet by Lessor to Lessee and rented by Lessee from Lessor for the period started in l .5, for the total rent stated in l .6, subject to the following terms and conditions:
2.2 General Conditions
The "General conditions applying to the tenancy agreement of limited duration for the lease of partly or fully furnished living accommodation", hereinafter called "The General Conditions", attached to the present agreement and incorporated therein by reference, shall be signed as correct by Lessor and Lessee.
2.3 Furnishings/Fixtures/Other Effects
The tenancy agreement and the total rent include the use of the furniture, fixtures, fittings and other effects available in the accommodation. The amount payable for such use has been specified in 1.6(b).
2.4 Inventory/State of repair
An inventory of the furnishings, fixtures and other effects, available and also a report describing the state of repair of the rented property at the commencement of the agreement, shall be drawn up in accordance with article 3 of the General Conditions.
2.5 Use
The rented property shall be used by the occupant and his / her family only as living accommodation.

2.6 Lessee/Occupant
In the event that Lessee mentioned in 1.2 rents the accommodation for the use of the occupant mentioned in 1.3, Lessee is obliged to inform the occupant of the substance of this agreement and the General Conditions belonging thereto. Lessee shall be held responsible for the fulfilment of all obligations under this agreement and, shall declare himself bound to accept and meet any obligation arising from transactions concluded or commitments made by the occupant on Lessee's behalf.

3. EXTENSION
3.1 Extension of tenancy/Final date of vacating
In the event that Lessor has the accommodation available for further letting on the date of expiry stated in 1.5(c), and Lessee wishes to extend his use of the accommodation for the reasons given in the prefatory statement to this agreement, the tenancy agreement can be extended by the period stated in
l .5(d) until the final date of vacating stated in l .5(e).
3.2 Automatic extension
The tenancy shall be extended automatically by the period stated in 3.1, unless due notice is given by either party that he/she does not wish to extend the agreement after the term of the tenancy stated in 1.5(b) has expired.
3.3 Notice of termination
Notice of termination must be given:
by registered letter or writ.
before the expiration of the tenancy.
subject to a period of notice of:
a. at least one calendar month in the case of Lessee.
b. at least six calendar months in the case of Lessor or if the tenancy agreement has been
concluded for less than one year, three calendar-months. by sending a copy to the agent(s) referred to in article 9.1 hereof.
The notice of termination shall, if applicable and legally required, serve as notification within the meaning of Section 1623(b) of Book 7 A of the Dutch Civil Code.
3.4 Diplomatic clause
Both Lessor and Lessee shall have the right to terminate the agreement at any time before the expiration of the tenancy:
a) in the event that Lessor's place of work is transferred to a location less than 50 kilometres from the rented property;
b) in the event that Lessee's place of work is transferred to a location more than 50 kilometres from the rented property. In such event the notice of termination shall be given:
by registered letter or writ,
before the first day of a calendar month,
subject to a period of notice of at least one calendar month and
by sending a copy to the agent(s) referred to in article 9.1 hereof.
3.5 Conditions with regard to vacating the premises
Lessee undertakes to vacate the rented property on the final date for quitting stated in l .5(e) at the latest, to remove all his personal belongings and to deliver up the accommodation in accordance with article 3.4 of the General Conditions.

4. INITIAL PAYMENT
4.1 Lessee undertakes to pay the first instalment of the rent together with the deposit on the date of signing this agreement.
4.2 Lessor hereby directs and authorises Lessee to pay the first instalment of the rent together with the deposit, either in cash or by remittance, into the bank account of the agent referred to in 9.1.
4.3 Upon receipt, the agent shall transfer the first instalment and the deposit less costs to Lessor's account.
4.4 The accommodation shall not be placed at Lessee's disposal until the amount stated in 4.1 has been received and this agreement has been signed.
4.5 Lessee shall be responsible for the rented property as from the date on which the agreement takes effect, or if earlier, from the date of receipt of the keys to the property.

5. ADDITIONAL SUPPLIES AND SERVICES
5.1 In addition to the property and its furnishings, fixtures and other effects being placed at Lessee's disposal, the supplies and services stated in l .6(c), l .6(d) and l .6(e) shall be provided.
5.2 The advances stated in l .6(c), l .6(d) an l .6(e) are included in the total periodic instalment. Final settlement shall, from time to time and also on the expiration or termination of the agreement, take place on the basis of the actual costs.

6. DEPOSIT
6.1 Lessee shall pay to Lessor the deposit stated in 1.6 as security for full performance of the terms of this (extended) agreement.
6.2 Lessee is not entitled to deduct the deposit from instalments of rent or other fmancial obligations under this agreement.
6.3 Lessor undertakes to return the deposit, or the balance thereof after deducting any amount owing to him by Lessee, within three months after the expiration or termination of this agreement.
6.4 Lessor will not pay interest over the deposit.

7. REGULAR PAYMENT OF RENT INSTALMENTS
The total periodic instalment stated in l .6 shall be paid in advance, without any deduction or set-off,
- before or not later than the first day of each period
- by standing order
- to the account stated in 1.1.

8. INDEXATION
8.1 The total rent stated in l .6 shall be adjusted annually, based on the current annual consumer price index, series for employed persons' families, as published by the Central Bureau of Statistics in The Hague: for the first time, one year after the date of commencement stated in l .5(a) by multiplication of the total rent stated in 1.6 (=A) by a fraction, the numerator of which shall be the price index for the calendar year preceding the year of adjustment (=B) and the denominator of which shall be the price index for the calendar year preceding the year of the date of commencement stated in l .5(a) (=C). The new rent is therefore equal to the result of A x (B:C).
8.2 The new rent shall never be lower than that of the preceding year.
8.3 Lessor undertakes to notify Lessee in writing of the increase not later than one month prior to the date on which a rent increase is to take effect pursuant to 8.1.


9. ACCOMMODATION AGENT(S) (IF APPLICABLE)
9.1 The services of ............................, in the capacity of accommodation agent(s), shall be rendered in accordance with the agent's General Conditions and Rates, which the parties have been informed about beforehand.
9.2 The appropriate agency fees shall be due and payable as from the date on which this agreement is signed.
9.3 The agent(s) cannot be held liable for non-performance or part performance of this agreement by Lessor and/or Lessee.

10. DOMICILE
For the purposes of this agreement Lessee shall register the rented accommodation as his elected domicile as from the date on which this agreement takes effect. If Lessee wishes to elect domicile elsewhere, he shall inform Lessor of his new address by registered letter. If he fails to do so, the rented accommodation shall continue to be regarded as his elected domicile.
